In 1990, the Federal Trade Commission (FTC) issued a consent order to the American Institute of Certified Public Accountants (AICPA). The order decreed the AICPA to lessen its longstanding ethics code which had until then banned the receipts of commissions, referral fees and contingent fees. The FTC alleged that the AICPA banned receipt of the fees as an attempt to restrain trade (FTC, 1990).In the present study, we sought to determine if CPAs'' preference for bans on commissions, referral fees and (...) contingent fees is related to their moral reasoning whereby CPAs perceive the bans to serve as a means of resolving ethical issues. While determining this matter cannot prove whether the bans did or did not actually result in restrained trade, it can offer insight into the perceived ethical importance to CPAs of the overturned rules. Based on a random sample of AICPA members and using Rest''s Defining Issues Test (DIT) to measure moral reasoning, we did not find a CPA''s moral reasoning to be related to his/her preference for ethics rules which ban commissions, referral fees or contingent fees. However, our results did indicate that most CPAs prefer banning commissions, referral fees and contingent fees, with those CPAs holding a higher financial stake in public accounting, namely partners, favoring banning referral fees and contingent fees significantly less than CPAs with a lesser stake. Further, we noted a significant negative relationship between financial stake and moral reasoning. These results seem to suggest that self-interest among CPAs may influence their moral reasoning.Further study is needed to examine the relationship between self-interest of CPAs and their moral reasoning. If self-interest clouds moral judgments made by CPAs, capital markets are in danger. Rendering an independent audit opinion must exclude self-interest. (shrink)

People talk about rats deserting a sinking ship, but they don't usually ask where the rats go. Perhaps this is only because the answer is so obvious: of course, most of the rats climb aboard the sounder ships, the ships that ride high in the water despite being laden with rich cargoes of cheese and grain and other things rats love, the ships that bring prosperity to ports like eighteenth-century Königsberg and firms such as Green & Motherby. By making the (...) insulting comparison - as I am in the course of doing – between us Kant scholars and a horde of noxious vermin, my more or less transparent aim is to mitigate, or at least to distract attention from, the collective immodesty of what I am saying about us. For my point is that, in the past half-century or so, Kant studies has become a very prosperous ship indeed. Its success has even been the chief thing that has buoyed all its sister ships in the fleet of modern philosophy, most of which are also doing very well. (shrink)

Attentional control theory (ACT) was proposed to account for trait anxiety’s effects on cognitive performance. According to ACT, impaired processing efficiency in high anxiety is mediated through inefficient executive processes that are needed for effective attentional control. Here we review the central assumptions and predictions of ACT within the context of more recent empirical evidence from neuroimaging studies. We then attempt to provide an account of ACT within a framework of the relevant cognitive processes and their associated neural mechanisms and (...) networks, particularly the fronto-parietal, cingular-opercula, and default mode networks. Future research directions, including whether a neuroscience-informed model of ACT can provide a platform for novel neurocognitive intervention for anxiety, are also discussed. (shrink)

_John Dewey and Continental Philosophy_ provides a rich sampling of exchanges that could have taken place long ago between the traditions of American pragmatism and continental philosophy had the lines of communication been more open between Dewey and his European contemporaries. Since they were not, Paul Fairfield and thirteen of his colleagues seek to remedy the situation by bringing the philosophy of Dewey into conversation with several currents in continental philosophical thought, from post-Kantian idealism and the work of Friedrich (...) Nietzsche to twentieth-century phenomenology, hermeneutics, and poststructuralism. This unique volume includes discussions comparing and contrasting Dewey with the German philosophers G. W. F. Hegel, Friedrich Nietzsche, Martin Heidegger, and Hans-Georg Gadamer on such topics as phenomenology, naturalism, organicism, contextualism, and poetry. Others investigate a series of connections between Dewey and contemporary French philosophy, including the notions of subjectivity, education, and the critique of modernity in Michel Foucault; language and politics in Jacques Derrida; and the concept of experience in Gilles Deleuze. Also discussed is the question of whether we can identify traces of _Bildung_ in Dewey’s writings on education, and pragmatism’s complex relation to twentieth-century phenomenology and hermeneutics, including the problematic question of whether Heidegger was a pragmatist in any meaningful sense. Presented in intriguing pairings, these thirteen essays offer different approaches to the material that will leave readers with much to deliberate. _ John Dewey and Continental Philosophy_ demonstrates some of the many connections and opportunities for cross-traditional thinking that have long existed between Dewey and continental thought, but have been under-explored. Paul Guyer's paper "Naturalistic and Transcendental Moments in Kant's Moral Philosophy" raises a set of issues about how Kantian ethics should be understood in relation to present day "philosophical naturalism" that are very much in need of discussion. The paper itself is challenging, even in some respects iconoclastic, and provides a highly welcome provocation to raise in new ways some basic questions about what Kantian ethics is and what it ought to be. Guyer offers us an admirably informed and (...) complex argument, both historical and philosophical, that tangles with some of the most difficult problems in Kant's moral philosophy. It begins with some ambitious and controversial claims about Kant's moral philosophy prior to the Groundwork of 1785. It then offers an interpretation, and also a fundamental criticism, of the Groundwork's attempt to establish the moral law based on the idea of freedom of the will. And finally, it raises - and expresses some opinions on - the large and vexed questions of the relationship between transcendental philosophy and philosophical naturalism, and whether Kantian ethics can be made consistent with a naturalistic philosophical outlook. In these comments I will have something to say on each of these three topics, without pretending (any more than Guyer does) to have exhausted what might be said about them. (shrink)

To the extent that one subscribes to the proposition, by now a virtual principle of criticism , that literary texts constitute sites for the negotiation, often vigorous, of power relations within a society, the reader of Catullus can hardly avoid some consideration of the poet's attitude toward contemporary political matters. It is a subject on which two principal lines of thought can be traced. Mommsen argued that Catullus responded to the enormities that followed the reinvigoration of the First Triumvirate at (...) the conference of Luca in 56 by occupying a thoroughly optimate position. Wilamowitz, on the other hand, insisted that Catullus' lyrics reflect only moments of the author's individual experience, amongst which expressions of personal distaste for certain public figures naturally appear but nothing which can appropriately be taken as indications of a political stance. The approach of Wilamowitz has proved more influential, followed in spirit if not in specifics by numerous commentators. To the degree that Catullus has been assimilated to the Augustan elegists, whose poems have been deemed by a scholar of the stature of Veyne to be anti-political in nature, it has been all the easier to reject the idea that Catullus adopts a political position, an assessment strongly maintained in a recent study by Paul Allen Miller, for whom the rejection of all political engagement is the sine qua non of true lyric poetry. Mommsen's optimate Catullus has lately found his champion, however, in a careful article by H. P. Syndikus. Although Miller and Syndikus, like Wilamowitz and Mommsen, draw diametrically opposed conclusions concerning politics in Catullus' poetry, they are agreed nevertheless that politics can be regarded as a relatively straightforward term: it refers to statecraft, matters of government, and party strife. Other readers, however, have been more self-conscious in their theoretical concerns, a salutary consequence of which has been a shift by some to a less narrow conception of the field of reference appropriate to discussions of ‘the political’ in Latin literature. First is the adopting of a certain ultimate moral attitude toward nature, which I call “respect for nature.” Second is a belief system that constitutes a way of conceiving of the natural world and of our place in it. This belief system underlies and supports the attitude in a way that makes it an appropriate attitude to take toward the Earth’s natural (...) ecosystems and their life communities. Third is a system of moral rules and standards for guiding our treatment of those ecosystems and life communities, a set of normative principles which give concrete embodiment or expression to the attitude of respect for nature. The theory set forth and defended here is, I hold, structurally symmetrical with a theory of human ethics based on the principle of respect for persons. (shrink)

I argue that supervenience is an inadequate device for representing relations between different levels of phenomena. I then provide six criteria that emergent phenomena seem to satisfy. Using examples drawn from macroscopic physics, I suggest that such emergent features may well be quite common in the physical realm.

In this strikingly original work, Paul W. Kahn rethinks the meaning of political theology. In a text innovative in both form and substance, he describes an American political theology as a secular inquiry into ultimate meanings sustaining our faith in the popular sovereign. Kahn works out his view through an engagement with Carl Schmitt's 1922 classic, _Political Theology: Four Chapters on the Concept of Sovereignty_. He forces an engagement with Schmitt's four chapters, offering a new version of each that (...) is responsive to the American political imaginary. The result is a contemporary political theology. As in Schmitt's work, sovereignty remains central, yet Kahn shows how popular sovereignty creates an ethos of sacrifice in the modern state. Turning to law, Kahn demonstrates how the line between exception and judicial decision is not as sharp as Schmitt led us to believe. He reminds readers that American political life begins with the revolutionary willingness to sacrifice and that both sacrifice and law continue to ground the American political imagination. Kahn offers a political theology that has at its center the practice of freedom realized in political decisions, legal judgments, and finally in philosophical inquiry itself. (shrink)

Louis G. Lombardi’s arguments in support of the claim that humans have greater inherent worth than other living things provide a clear account of how it is possible to conceive of the relation between humans and nonhumans in this way. Upon examining his arguments, however, it seems that he does not succeed in establishing any reason to believe that humans actually do have greater inherent worth than animals and plants.

Paul and Religion demonstrates the continuing and contemporary relevance of the most important, and most controversial, figure of early Christianity. Paul Gooch interrogates the Pauline writings for their meaning as well as implications for religion as an entire form of life, a stance on the world expressed in distinctive practices. Bringing a philosophical approach to this topic, he connects Paul's ideas to lived experience. In a conversational style, Gooch explores Paul's experience of grace and his dismissal (...) of distinctive markers of religious identity in favour of love as binding together a community. Contrary to common expectations, he finds within Paul's letters material for conversations about issues in our day, such as gender and sexuality. From his close reading of the Letters, Gooch argues that the Pauline religious form of life is not identical with institutional Christianity. Indeed, his conclusions may be welcome to those who belong to other faiths. (shrink)

1 Adaptationism is a research strategy that seeks to identify adaptations and the specific selective forces that drove their evolution in past environments. Since the mid-1970s, paleontologist Stephen J. Gould and geneticist Richard Lewontin have been critical of adaptationism, especially as applied toward understanding human behavior and cognition. Perhaps the most prominent criticism they made was that adaptationist explanations were analogous to Rudyard Kipling's Just So Stories. Since storytelling is an inherent part of science, the criticism refers to the acceptance (...) of stories without sufficient empirical evidence. In particular, Gould, Lewontin, and their colleagues argue that adaptationists often use inappropriate evidentiary standards for identifying adaptations and their functions, and that they often fail to consider alternative hypotheses to adaptation. Playing prominently in both of these criticisms are the concepts of constraint, spandrel, and exaptation. In this article we discuss the standards of evidence that could be used to identify adaptations and when and how they may be appropriately used. Moreover, building an empirical case that certain features of a trait are best explained by exaptation, spandrel, or constraint requires demonstrating that the trait's features cannot be better accounted for by adaptationist hypotheses. Thus, we argue that the testing of alternatives requires the consideration, testing, and systematic rejection of adaptationist hypotheses. Where possible, we illustrate our points with examples taken from human behavior and cognition. Paul Ludwig examines how and why Greek theorists treated political passions as erotic. Because of the tiny size of ancient Greek cities, contemporary theory and ideology could conceive of entire communities based on desire. A recurrent aspiration was to transform the polity into one great household that would bind the citizens together through ties of mutual affection. In this study, Ludwig evaluates sexuality, love, and civic friendship as sources of political attachment and as bonds of political association.

Gene Spitler has raised certain objections to my views on the biocentric outlook: that a factual error is involved in the assertion that organisms pursue their own good, that there is an inconsistency in the biocentric outlook, that it is impossible for anyone to adopt that outlook, and that the outlook entails unacceptable moral judgments, for example, that killing insects and wildfiowers is as morally reprehensible as killing humans. I reply to each of these points, showing that the biocentric outlook (...) on nature is not only a possible, but also a reasonable world view. (shrink)

In this wide-ranging interdisciplinary work, Paul W. Kahn argues that political order is founded not on contract but on sacrifice. Because liberalism is blind to sacrifice, it is unable to explain how the modern state has brought us to both the rule of law and the edge of nuclear annihilation. We can understand this modern condition only by recognizing that any political community, even a liberal one, is bound together by faith, love, and identity.Putting Liberalism in Its Place draws (...) on philosophy, cultural theory, American constitutional law, religious and literary studies, and political psychology to advance political theory. Love is the foundation of a world of objective meaning, one form of which is the political community. Arguing from these insights, Kahn offers a new reading of the liberalism/communitarian debate, a genealogy of American liberalism, an exploration of the romantic and the pornographic, a new theory of the will, and a refoundation of political theory on the possibility of sacrifice.Approaching politics from the perspective of sacrifice allows us to understand the character of twentieth-century politics, which combined progress in the rule of law with massive slaughter for the state. Equally important, this work speaks to the most important political conflicts in the world today. It explains why American response to September 11 has taken the form of war, and why, for the most part, Europeans have been reluctant to follow the Americans in their pursuit of a violent, sacrificial politics. Kahn shows us that the United States has maintained a vibrant politics of modernity, while Europe is moving into a postmodern form of the political that has turned away from the idea of sacrifice.
